Scope
This policy explains how EBITPOINT LTD handles claims that material available through ebitpoint.com infringes someone's copyright. It covers material we publish, such as guides and images, and material customers submit for publication, such as reviews.
EBITPOINT LTD is a company registered in Ghana. We follow a notice-and-takedown process based on the United States Digital Millennium Copyright Act (17 U.S.C. § 512), and we handle every notice in line with Ghana's Copyright Act, 2005 (Act 690) and other applicable law, wherever the rights holder is located.
Before you send a notice
Make sure you own the copyright, or are authorised to act for the owner, and that the use you are reporting is not allowed by a licence or by law, such as fair use, fair dealing, or quotation for review or news reporting. If you are not sure, consider getting legal advice first.
What your notice must include
Your notice must be in writing and include all of the following:
- Your physical or electronic signature, as the copyright owner or a person authorised to act for them.
- A description of the copyrighted work you say has been infringed. If there are several works, a representative list is enough.
- The exact web address (URL) of the material on ebitpoint, and enough detail for us to find it.
- Your full name, postal address, telephone number, and email address.
- A statement that you believe in good faith that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for the owner.
We may not act on a notice that leaves out any of these details. Where a notice identifies the work but is incomplete, we will contact you to ask for the missing information.
Where to send it
| Method | Details |
|---|---|
| Email (preferred) | info@ebitpoint.com, with the subject line “Copyright notice” |
| Post | EBITPOINT LTD, Fadama Night Market, opposite Kelewele Junction, North Kaneshie, Accra, Ghana |
Send only copyright notices and counter-notices to these details with that subject line. Other messages sent this way may not get a reply as quickly as through Support.
What happens after we receive a notice
- We check that the notice is complete and review the material it identifies.
- If the notice is valid, we remove the material or disable access to it promptly.
- If a customer submitted the material, we tell them it was removed and may send them a copy of the notice, including the sender's name and contact details, so they can respond.
- We confirm to the sender what action we have taken.
We may also remove material that comes to our attention in other ways if we believe it infringes someone's rights.
Counter-notices
If material you submitted was removed and you believe that was a mistake or that the material was wrongly identified, you can send a counter-notice to the details in section 4. It must include:
- Your physical or electronic signature.
- A description of the material that was removed and the web address where it appeared before removal.
- A statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled because of a mistake or misidentification.
- Your full name, postal address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the courts of Ghana or, if your address is in the United States, of the federal district court for the district where your address is located, and that you will accept service of legal documents from the person who sent the original notice or their agent.
Restoring material
When we receive a valid counter-notice, we send a copy to the person who sent the original notice and tell them that we may restore the material. We restore it, or stop disabling access to it, between 10 and 14 business days after receiving the counter-notice, unless the original sender first tells us they have started court proceedings to stop the infringement.
False or misleading notices
Anyone who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for the damages, costs, and legal fees that result. Do not use this process to remove content you simply disagree with, such as a genuine customer review.
Repeat infringers
Where appropriate, we may restrict or close the account of a customer who repeatedly submits infringing material.
Changes to this policy
We may update this policy from time to time. The current version and its update date are always shown on this page. See our Copyright policy for how you may use ebitpoint content.
